Active members of legal age and with unlimited legal capacity have the right to use KIJAST products with the monthly subscription specified on the website without restrictions. However, the resale of our products is prohibited, and copyrights are not transferred to members. All audio and video files can be accessed in English at any time and place with an internet connection. Digital files are only available for use in English.
2.1 Active members are male/female/diverse: They make their subscription payment by the 5th of the following month (the date of receipt by KIJAST applies) and are entitled to build a team and earn commissions according to the compensation plan. We also refer to them as independent distributors or contractors.
2.2 Inactive members are male/female/diverse: Those who fail to pay their monthly subscription by the 5th of the following month will have their learning platform deactivated, and any existing commission payments will be stopped immediately without retroactive claims, even if payments are made late. To become active again, the payment must be updated and made monthly by the 5th of the month to benefit from the compensation plan. The date of receipt by KIJAST applies.
3.1 Level 1 equals 20% of payments from active members (directly recruited by the active member).
3.2 Level 2 equals 10% of payments from active members (recruited by your active Level 1 team).
3.3 Level 3 equals 5% of payments from active members (recruited by your active Level 2 team).
3.4 Level 4 equals 5% of payments from active members (recruited by your active Level 3 team).
3.5 Level 5 equals 5% of payments from active members (recruited by your active Level 4 team).
3.6 Active members are compensated up to Level 5 in depth. There are no limitations in breadth.
Payments are made to active members by the 15th of the following month.
Payments from active members are made either via PayPal or bank transfer. Members can use PayPal for subscription checkouts or request a bank transfer. KIJAST reserves the right to choose whether payouts are made via PayPal or bank transfer. Fees for payments to KIJAST via PayPal are covered by KIJAST, but fees for payouts to members are borne by the members and deducted accordingly.
If our server malfunctions or experiences temporary issues, members are not entitled to claim damages against KIJAST. Members agree to this. KIJAST will endeavor to resolve server issues as quickly as possible.
As an active member, you agree that you are an independent contractor and not an employee, legal representative, or franchisee of KIJAST. Furthermore, you agree that you are solely responsible for covering your expenses, including travel, food, accommodation, secretarial services, office supplies, long-distance calls, marketing costs, and other expenses related to building your downline. YOU UNDERSTAND THAT YOU WILL NOT BE TREATED AS AN EMPLOYEE OF KIJAST IN ANY WAY.
KIJAST is not responsible for withholding taxes or social contributions from commission payments to active members. All applicable taxes, fees, chamber dues, and social contributions must be declared and paid independently by each active member in their country of residence.
By registering on the KIJAST platform, all members agree that their personal data, including bank and PayPal details, will be stored and processed internally for the purpose of monthly billing. This includes displaying team structures to recruiting members of referred members.
After successful registration, each member receives a personalized link to recruit new partners for their downline. Active members may share this link through various channels, provided it complies with the guidelines of the respective platforms and laws. Platforms like eBay and shopping malls may not be used. Responsibility for unauthorized link distribution lies with the member who distributed it, and KIJAST distances itself from any such activity.
Active members have the right to register new members with KIJAST. Members who sign up for a paid monthly subscription are automatically qualified to earn commissions according to the KIJAST compensation plan for up to five levels.
Misrepresentation, fraud attempts, or individuals who are legally incapable or minors under applicable laws of legal capacity.
A minimum of three months, automatically extended monthly as long as the subscription payment is made on time.
Termination is possible by either party via email or post without specific reason after three months from initial registration with a 30-day notice period from the date the email is sent or the post is received. If a member fails to pay for three consecutive months, the membership is automatically terminated, and the three months' fees remain payable. Upon termination or non-renewal, the (former) member forfeits all rights related to KIJAST, including ownership and commission rights to their downline. A departing member explicitly agrees to permanently lose all rights as a member or member company, particularly commission entitlements.
Inactive members wishing to reactivate or make data changes, such as bank or address updates, incur a one-time processing fee of 30.00 euros per change.
Before registering, members agree that individual terms, policies, or the compensation plan may be amended, deleted, or added by KIJAST. Changes will be published on the website and will take effect 30 days after publication or sooner if legally required.
KIJAST reserves the right to reorganize or sell the company at any time, with contractual terms remaining in effect.
Upon termination, members agree to maintain confidentiality about KIJAST information and content and not disclose it publicly.
In the event of a member's death, commission entitlements expire, and the membership ends automatically. An independent distributor must have been active for at least one year to sell their business, with prior approval from KIJAST.
Members who pay their subscription by the 5th of the following month are eligible. Late payments result in forfeited commissions. However, the downline remains intact for three months, allowing reactivation to qualify for future commissions. Violations of terms result in forfeiture of bonuses or commissions, regardless of sales.
An active member recruits 40 new active members, generating subscription fees:

Without prior written consent from KIJAST, members may not assign rights or delegate obligations under the contract. Any attempt to transfer or assign the agreement without KIJAST's explicit written consent renders the agreement void at KIJAST's discretion and may lead to the termination of the collaboration. Members are aware that if the terms of the agreement are not upheld, KIJAST reserves the right to impose disciplinary measures at its sole discretion as outlined by applicable law.
All members have carefully read and agreed to comply with the KIJAST guidelines (in accordance with applicable law) and the KIJAST compensation plan, both of which are incorporated into these General Terms and Conditions and made a part thereof.
"If any provision of this agreement is invalid or unenforceable, or becomes invalid or unenforceable after the contract is concluded, the validity of the remaining provisions of the contract shall remain unaffected."
"In place of the invalid or unenforceable provision, a valid and enforceable provision shall be applied that comes closest to the economic purpose intended by the parties with the invalid or unenforceable provision. The same applies if the contract proves to be incomplete."
KIJAST or its affiliates, directors, officers, shareholders, employees, assignees, and representatives (collectively referred to as "affiliates") shall not be held liable for claims and shall be indemnified by members for consequential and exemplary damages related to the agreement.
I further agree to indemnify KIJAST and its affiliates from any liability arising from or in connection with: (a) violation of this agreement by a member or affiliated member (as determined by applicable law); (b) promotion or operation of a KIJAST business by a member or affiliated member and all related activities, including but not limited to the presentation of KIJAST products or the KIJAST compensation plan, operation of a vehicle, leasing of meeting or training facilities, etc.; (c) false data or information provided to KIJAST by a member or affiliated entity; (d) failure of an affiliated member entity to provide information or data necessary for KIJAST to operate its business; or (e) bonuses resulting from unauthorized actions by the member in operating their business. Indemnity and Hold Harmless.
The independent distributor, as an active member, indemnifies and holds harmless the company, its officers, directors, agents, and representatives from and against the full amount of all claims, causes of action, judicial or administrative proceedings, lawsuits, fees, liabilities, losses, damages, costs, and expenses, including but not limited to court costs and reasonable fees and expenses of attorneys and consultants, which may be filed, initiated, or assessed against the company at any time resulting from the operations and representations of the independent distributor arising from:
a) Violation and/or non-compliance with the terms of the independent distributor agreement, guidelines and procedures, rules and regulations, marketing program handbook, or other instructions from the company regarding the method and manner of conducting the independent distributor's business;
b) Engaging in behaviors not authorized by the company on the market;
c) Fraud, negligence, or intentional misconduct in the operation of the independent distributor's business;
d) Misrepresentation or unauthorized representation regarding the company's product or service, marketing opportunity, potential, or program;
e) Non-compliance with federal, state, or local laws, regulations, ordinances, and/or other orders issued by a competent court;
f) Engaging in actions beyond the independent distributor's authority;
g) Engaging in activities by the independent distributor over which the company has no effective control;
h) Participation in the general business operations of the independent distributor's business.
The agreement, in its current form and as amended by KIJAST in accordance with local, state, federal, or international laws, constitutes the entire contract between KIJAST and the member. Any promises, representations, offers, or other communications not expressly set forth in the agreement are ineffective.
Any waiver by KIJAST of a breach of the agreement must be in writing and signed by an authorized representative of KIJAST. A waiver of any breach does not constitute a waiver of any subsequent breach.
This agreement is governed by the laws of Republika Srpska in Bosnia and Herzegovina and will be interpreted in accordance with these laws, without regard to conflict-of-law principles. All disputes and claims related to KIJAST, the member or affiliate member agreement, the KIJAST compensation plan, its products and services, or other claims or causes of action will be resolved exclusively and finally through arbitration in Banja Luka, Republika Srpska, Bosnia and Herzegovina, or another location specified by KIJAST, in accordance with the federal court system. All matters related to arbitration are subject to the court in Banja Luka, Republika Srpska, Bosnia and Herzegovina. The arbitrator's decision is final and binding and may be reduced to judgment before a competent court in Republika Srpska if necessary. Each party to the arbitration is responsible for their own costs and expenses of arbitration, including attorney and filing fees. This arbitration agreement survives termination or expiration of the agreement. Nothing in the agreement prevents KIJAST from seeking an attachment, garnishment, injunction, or other equitable relief to protect its interests.
If a member or affiliate member wishes to file a claim against KIJAST for any act or omission in connection with the agreement, such claim must be filed within one year of the alleged conduct giving rise to the claim. Failure to file such a claim within this time period bars all claims against KIJAST for such act or omission. The member or affiliate member waives all claims that other statutes of limitation apply.
Members have the right to withdraw from this contract within fourteen days without giving reasons by email or post.
KIJAST, hereinafter referred to as "the company," is a direct sales company for marketing digital learning video and audio products through a monthly membership. The policies and procedures contained herein apply to all members and independent distributors as active members. In this statement, "member" refers to individuals who register with us and use the company to access our digital learning product world and independent distributors who, as active members, also build their online business with us and participate in the KIJAST compensation plan ("compensation plan"). The term "sponsor/enroller" refers to any independent distributor as an active member who directly enrolls a new active member under them or places them in their registration organization as defined in the compensation plan.
An independent distributor is a self-employed and independent representative who, as an active member, builds a business with us and must comply with all points of these General Terms and Conditions during implementation. The company reserves the right to accept or reject any independent distributor as an active member.
Independent distributors as active members are independent marketing representatives of the company and are not considered buyers of a franchise or independent distributors. The agreement between the company and its independent distributors as active members does not establish an employer-employee relationship. Each independent distributor must indemnify and hold the company harmless from any claims, damages, or liabilities arising from the actions and business practices of independent distributors as active members. Independent distributors as active members have no authority to bind the company to any obligation. Each independent distributor as an active member is encouraged to set their own working hours and determine their own sales methods, provided they comply with the company's guidelines and procedures.
For the company's success, it is crucial that distributors as active members ensure the integrity of communication when submitting transactions to the company. All transactions submitted to the company, including but not limited to applications for independent distributors as active members, communications, financial transactions for independent distributors, and consumer transactions, must be submitted by the person or organization involved in the transaction. Submission by third parties and all transaction submissions are prohibited, except for the exceptions listed below. An independent distributor as an active member may not submit transactions on behalf of another person. Unless waived, an independent distributor as an active member may not use their bank accounts to deposit the monthly fees of new active members; all membership fees must be deposited and booked through the company. This rule applies to all participants in our online business. Forms of transaction submissions include, but are not limited to, online, telephone, fax, and email.
If the company determines during the verification process that independent distributors as active members were registered without providing their specific requested information and without agreeing to the General Terms and Conditions, the contract with the company will not be established and will be considered void.
When conducting business activities, the independent distributor as an active member is required to protect and promote the reputation of the company's products and services. They must refrain from any behavior that could damage the company's reputation or is inconsistent with the public interest when marketing such products and services. Avoid any rude, fraudulent, misleading, unethical, or immoral behavior or practices. The independent distributor as an active member must not disturb, harass, or undermine other independent distributors and must respect the privacy of other independent distributors at all times. The independent distributor as an active member must not disparage the company, its affiliates, or other companies.
KIJAST members and independent distributors as active members typically have one main account. Additional accounts are not permitted. Independent distributors as active members may not use a social security number, username, or email address belonging to another person in the system. KIJAST reserves the right to reject accounts that could be perceived as impersonating another person. Such actions violate intellectual property rights or other rights and are expressly prohibited.
Independent distributors as active members of KIJAST are permitted and even encouraged to apply to other multi-level marketing companies and operate their businesses, provided these companies also allow participation in KIJAST and do not offer competing products or similar offerings. Let us review this together if necessary.
All active members pay a membership fee upon registration and monthly thereafter to access our digital learning products. Additionally, active members qualify to build their online business. Only the monthly membership fees apply. The fee is not a service or franchise fee but is solely for accessing our diverse digital courses. KIJAST does not charge a separate registration fee.
The independent distributor as an active member, acting as an independent contractor, is fully responsible for all their verbal and written statements regarding products or services not directly provided by the company. The independent distributor as an active member agrees to indemnify and hold the company harmless from any liabilities, including judgments, civil penalties, refunds, attorney fees, court costs, or lost business. The company does not allow the use of its copyrights, designs, logos, trade names, etc., without prior written permission. All company materials, whether printed, filmed, recorded, or online, are copyrighted and may not be reproduced in whole or in part without prior company approval. Unauthorized email solicitation for recruitment is strictly prohibited. Each email sent for the company by an independent distributor as an active member must meet the following criteria:
a) A valid reply email address must be included.
b) The email must notify the recipient that they can opt-out of receiving further emails by replying to the provided address.
c) The email must clearly state that it is an advertisement.
d) Misleading subject lines or false header information are prohibited.
e) All opt-out requests must be honored, regardless of how they are received.
f) Do not engage in spamming or automated calling systems in connection with your business.
"Spamming" or bulk email is strictly prohibited.
The company reserves the right to approve or reject changes to the company name or partnerships created by independent distributors as active members. These are evaluated on a case-by-case basis. No changes may be made to circumvent company rules.
The company reserves the right to require reimbursement of any commission previously paid if the product/service purchase is canceled or refunded. Reimbursement will be adjusted in the next month's payout for the independent distributor as an active member.
The company reserves the right to change, add to, or modify products, services, and monthly membership prices.
Media inquiries must be forwarded to KIJAST and may not be answered by members.
The company never waives its right to enforce compliance with these rules or other applicable laws governing business operations. Any waiver must be in writing and signed by an authorized company officer.
This agreement is governed by the laws of Republika Srpska in Bosnia and Herzegovina.
